This website and online store are operated by Lunaise LLC under the ByZayn.co brand. Throughout these Terms, “we,” “us,” and “our” refer to Lunaise LLC and ByZayn.co. By visiting the website, placing an order, or using any store service, you agree to these Terms of Service.
1. Eligibility and acceptable use
You must be legally capable of entering into a binding contract in your jurisdiction. You may not use the website or our products for an unlawful, fraudulent, abusive, or unauthorized purpose, interfere with store security, transmit malicious code, scrape the website without permission, or infringe another person’s rights.
2. Product information
We make reasonable efforts to display product descriptions, photographs, colors, dimensions, materials, and prices accurately. Screen settings, lighting, production methods, and fabric batches can cause minor variations. Because many products are made to order, slight print-placement or color variations that do not materially change the design are not considered defects.
Customers are responsible for reviewing the size chart and product details before ordering. Availability may change without notice.
3. Orders and acceptance
An order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance. We may decline or cancel an order for suspected fraud, pricing or inventory errors, payment problems, legal restrictions, or an inability to fulfill the order. If we cancel a paid order, the applicable amount will be refunded.
4. Prices, currencies, and taxes
Prices may be displayed in different currencies according to the customer’s market. Currency conversion and rounding may be applied by Shopify or the payment provider. Taxes, customs duties, import charges, and similar government fees are handled as disclosed at checkout and in our Shipping & Delivery policy.
5. Payment
You agree to provide current, complete, and accurate billing and payment information. Payment processing is provided by Shopify and supported third-party payment providers. We do not directly store full payment-card details.
6. Production, shipping, and delivery
Most products are made to order. Processing and delivery estimates are described in our Shipping & Delivery policy. Estimated delivery dates are not guarantees. Risk and ownership transfer as required by the law applicable to the transaction.
7. Returns, refunds, and consumer rights
Returns and refunds are governed by our Returns & Exchanges policy. Nothing in these Terms excludes or restricts mandatory rights or remedies that cannot lawfully be waived, including rights relating to faulty, misdescribed, or non-conforming goods.
8. Intellectual property
The website, brand elements, product designs, graphics, photographs, text, logos, and other content are owned by or licensed to Lunaise LLC and are protected by intellectual-property laws. They may not be copied, reproduced, distributed, modified, or commercially used without prior written permission.
9. Third-party services and links
The store may rely on Shopify, payment processors, production partners, carriers, analytics providers, and other third parties. Third-party services and websites are governed by their own terms and privacy practices. We are not responsible for third-party content outside our control, subject to applicable law.
10. Disclaimer and limitation of liability
To the maximum extent permitted by law, the website and services are provided on an “as available” basis. We are not liable for indirect, incidental, special, or consequential loss arising from use of the website or products where such liability may lawfully be excluded. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful use of the website, breach of these Terms, or infringement of another person’s rights.
12. Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in effect. The invalid provision will be applied only to the maximum extent permitted by law.
13. Governing law
These Terms are governed by the laws applicable to Lunaise LLC in the State of Wyoming, United States, without depriving consumers of mandatory protections available under the law of their habitual residence.
14. Changes
We may update these Terms by publishing a revised version on the website. Changes apply from the stated effective date and do not retroactively remove rights already acquired under a completed purchase.
